Federal OSHA Vaccine Mandate Overturned By High Court
Fri 1-14-2022
(Washington D.C.)- The federal mandate which would have enforced a requirement for either vaccines or weekly tests in all employers with over 100 employees was blocked by The Supreme Court 6-3. They did however approve the Biden Administration's request for a similar mandate for healthcare workers across the country, that separate decision was approved 5-4.
It was estimated by the administration that the OSHA mandate would have applied to over 80 million workers, with some estimates closer to 100 million.
The high court released this statement with their decision.
"Although Congress has indisputably given OSHA the power to regulate occupational dangers, it has not given that agency the power to regulate public health more broadly. Requiring the vaccination of 84 million Americans, selected simply because they work for employers with more than 100 employees, certainly falls in the latter category."
Curbing powers requested by OSHA and the Biden Administration, the president said he was disappointed that the court did not approve the mandate, but was happy that at least healthcare workers will need to follow the new rules.
